I want to write an agreement with a company who is developing software for me. I want to make sure that if the company fails to develop software as agreed he shouldthey will refund money I paid to them uptoup to that point.

I have compiled the following sentence. Is this the best format to put the clause?

'In any unfortunate situation the 'company' fails to complete the project as outlined in the requirement document published by Mr.Mark. 'Company' should offer full refund of money paid upto that period by Mr. Mark'
